Terms of Service for Pinpin

By accessing or using the Pinpin mobile application ("the App"), you
agree to be bound by these Terms of Service. If you disagree with any
part of these terms, you may not use the App.
1. Interpretation and Definitions
1.1 Definitions
For the purposes of these Terms of Service:

"Application" or "App" means the
Pinpin mobile software program provided by the Company.

"Application Store" means the digital distribution
service operated by Google Inc. (Google Play Store) or Apple Inc. (Apple
App Store) where the App is distributed.

"Company", "We",
"Us", or "Our" refers to Pinpin.
- "Country" refers to the Philippines.

"Device" means any device that can access the Service
such as a smartphone or tablet.

"Service" refers to the Application and all features
provided therein.
- "Terms" mean these Terms of Service.

"You" or "User" means the individual
accessing or using the Service.

"Free Features" means App features available to all
users without payment, including Crisis Mode, Debt Tools, and base
financial missions.

"Premium Features" means features available only to
users who have purchased Pinpin Premium, including the
Investment Tracker, Budget Calendar, Resume Builder, and all Gameplan
Dashboards (Early Freedom, Wealth Builder, Growth Maximizer,
Anti-Fragile Defender, and Family Provider).

"Pinpin Premium" means the one-time in-app purchase
(product ID:
pinpin_premium_lifetime) available through the
Google Play Store that permanently unlocks all Premium Features.
2. Acknowledgment and Acceptance
These Terms govern your use of Pinpin and constitute a binding legal
agreement between you and the Company.
By using Pinpin, you acknowledge and agree that:

You are at least 18 years old (Pinpin is not intended
for minors)

- You agree to comply with all applicable Philippine laws

You will use the App responsibly and in accordance with these Terms

Pinpin is NOT a financial advisor, accountant, or financial
planner.
The App provides:

The App does NOT provide:

IMPORTANT: All financial information, recommendations,
and calculations provided by Pinpin are for
educational purposes only. You should consult with a
licensed financial advisor, accountant, or financial planner before
making any significant financial decisions.
We are not liable for any financial losses resulting from your use of
the App or decisions made based on the App's guidance.
4. No Legal Advice
Pinpin is NOT a law firm and does not provide legal advice or legal
representation.
The App provides:

General information about your legal rights under Philippine law

The App does NOT provide:
- β Legal advice specific to your individual situation

- β Guarantees about the outcome of any legal action you take
- β Attorney-client privilege or confidentiality
IMPORTANT: All legal information provided by Pinpin is
for educational purposes only. You should consult with
a licensed attorney (such as the
Public Attorney's Office - PAO) before taking any legal
action.
We are not liable for any legal consequences resulting from
complaints filed using the App or decisions made based on the App's
legal guidance.
5. Acceptable Use Policy
5.1 Permitted Uses
You may use Pinpin to:
- Analyze your personal financial situation
- Track your income, expenses, debts, and savings
- Calculate your financial health score
- Complete financial wellness missions
- Generate complaint letters to report debt harassment

Access educational content about personal finance and Philippine law

Manage bill schedules and receive push notification reminders for
upcoming and overdue bills

Purchase and use Pinpin Premium features (Investment Tracker, Budget
Calendar, Resume Builder, Gameplan Dashboards)
5.2 Prohibited Uses
You may NOT use Pinpin to:
- β Enter false, misleading, or fraudulent information
- β File false harassment complaints against lenders
- β Harass, threaten, or abuse any person or entity
- β Violate any Philippine laws or regulations

β Reverse engineer, decompile, or attempt to extract the App's source
code

β Use the App for commercial purposes without our written permission

β Copy, modify, distribute, or create derivative works from the App
- β Interfere with or disrupt the App's functionality or security
- β Attempt to gain unauthorized access to other users' data
Violation of these prohibited uses may result in immediate termination
of your access to the App and potential legal action.
6. User Responsibilities
By using Pinpin, you agree that:
6.1 Accuracy of Information
- You will provide accurate, complete, and truthful information
- You will update your information when it changes

You understand that the App's analysis is only as accurate as the data
you provide
6.2 Financial Decisions
- You are solely responsible for your financial decisions

You will not rely solely on the App's guidance without consulting
professionals

You understand that past performance is not indicative of future results
- You accept all financial risks associated with your decisions
6.3 Legal Actions

You are solely responsible for any complaints or legal actions you file
- You will not file false or fraudulent complaints

You will consult with a lawyer before taking any significant legal
action

You understand that the App does not guarantee the outcome of any
complaint or legal action
6.4 Device Security

You will keep your device secure with a passcode or biometric lock
- You will not share your device with untrusted individuals

You will notify us immediately if you suspect unauthorized access to
your data
6.4 Notification Permissions

You understand that push notifications are optional and can be disabled
at any time in your device settings

You understand that disabling notifications may cause you to miss bill
reminders and mission nudges

You understand that all notifications are scheduled locally on your
device based on data you have entered into the App
7. Intellectual Property Rights
7.1 Ownership
The Pinpin App, including all content, features, functionality, source
code, algorithms, and user interface, is owned by Pinpin and is protected
by Philippine and international copyright, trademark, and other
intellectual property laws.
7.2 License Grant
We grant you a limited, non-exclusive, non-transferable, revocable license
to:
- Download and install the App on your personal device
- Use the App for your personal, non-commercial purposes
This license does NOT permit you to:
- Modify, adapt, or create derivative works
- Distribute, sell, lease, or sublicense the App
- Reverse engineer or decompile the App
- Remove or alter any copyright or proprietary notices
7.3 User Data Ownership
You own all the personal and financial data you enter into the
App.
We do not claim ownership of your data. By using the App, you grant us a
limited license to use your anonymized, aggregated data for the purpose of
improving the App's features and algorithms.
8. Premium Features and In-App Purchases
8.1 Pinpin Premium
Pinpin offers a one-time in-app purchase called
Pinpin Premium (product ID:
pinpin_premium_lifetime) through the Google Play Store.
Purchasing Premium permanently unlocks the following features:

π Investment Tracker β portfolio tracking for PH and
global assets

π Resume Builder β professional resume creator for
Filipino job seekers

πΊοΈ Gameplan Dashboards β Early Freedom, Wealth Builder,
Growth Maximizer, Anti-Fragile Defender, and Family Provider dashboards
8.2 Payment Processing
All payments are processed by Google Play. Pinpin does
not collect, store, or process any payment card or financial account
information. By purchasing Pinpin Premium, you agree to be bound by Google
Play's Terms of Service and billing policies.
Pinpin uses RevenueCat as a purchase verification
service. RevenueCat confirms your entitlement status with Google Play and
returns whether your account is Premium or Free. RevenueCat does NOT
process payments or receive your payment details. By purchasing Pinpin
Premium, you also agree to be bound by
RevenueCat's Terms of Service.
8.3 No Refunds
Because Pinpin Premium is a
one-time lifetime purchase that grants immediate access
to all Premium Features, refunds are governed by the
Google Play refund policy. We generally do not offer
additional refunds outside of Google Play's standard refund window. To
request a refund, use the Google Play Store app or visit
Google Play Help.
8.4 Restore Purchase
If you reinstall the App or change devices, you can restore your Premium
access at no additional cost using the "Restore Purchase"
option within the App. Restoration requires the same Google Play account
used for the original purchase.
8.5 Free Features Remain Free
Purchasing Premium does not affect your access to Free Features. Crisis
Mode, all Debt Tools (Harassment Reporter, Threat Scanner, OLA Trap
Scanner, Demand Letter Generator, etc.), base financial missions, and
educational content remain free for all users indefinitely.
βΉοΈ NOTE: Pinpin Premium is a
one-time purchase β not a subscription. You will never
be charged automatically or on a recurring basis.
9. Links to Third-Party Websites
The App may contain links to third-party websites, including:

Philippine government agency websites (SEC, NBI, NPC, PhilHealth, SSS,
Pag-IBIG)
- Educational resources about personal finance
- Support and help documentation
We are not responsible for:

The content, privacy policies, or practices of third-party websites

Any damages or losses arising from your use of third-party websites
-
The accuracy or reliability of information on third-party websites
We strongly advise you to review the privacy policies and terms of service
of any third-party websites you visit.
10. Termination
10.1 Termination by You
You may stop using the App at any time by:
- Uninstalling the App from your device
- Using the "Fresh Start Mode" feature to delete all your data
- Contacting us to request account deletion
10.2 Termination by Us
We may suspend or terminate your access to the App immediately, without
prior notice, if:
- You violate these Terms of Service
- You engage in fraudulent or illegal activities

You abuse the App's features (e.g., filing false harassment complaints)
- We are required to do so by law
- We discontinue the App
10.3 Effect of Termination
Upon termination:
- Your right to use the App will cease immediately
- All locally stored data will be deleted from your device
- We may retain certain data if required by law
10.4 Premium Purchases Upon Termination
If your access to the App is terminated for violations of these Terms, you
will lose access to Premium Features. In-app purchase refunds in this case
are subject to Google Play's refund policy β Pinpin will not issue
additional refunds for accounts terminated due to policy violations.
11. Limitation of Liability
CRITICAL: READ THIS SECTION CAREFULLY
TO THE MAXIMUM EXTENT PERMITTED BY PHILIPPINE LAW:
11.1 No Guarantees
We do NOT guarantee:
- That the App will be error-free, uninterrupted, or secure

That the App's financial analysis or recommendations are accurate
- That you will achieve any specific financial results
-
That harassment complaints filed using the App will be successful
- That government agencies will take action on your complaints
11.2 Financial Losses
WE ARE NOT LIABLE FOR:

Financial losses resulting from decisions made based on the App's
guidance
- Losses due to errors or inaccuracies in the App's calculations
-
Losses due to debt payoff strategies that don't work for your
situation
- Interest charges, penalties, or fees incurred on your debts
- Lost opportunities or investments
11.3 Legal Consequences
WE ARE NOT LIABLE FOR:
- Outcomes of harassment complaints filed using the App
- Legal fees or costs incurred in pursuing legal action
- Retaliation or counterclaims from lenders
- Damages resulting from incorrect legal information
11.4 Data Loss
WE ARE NOT LIABLE FOR:

Loss of data due to device failure, uninstallation, or user error
- Data breaches or unauthorized access to your device
- Corruption or loss of data during app updates
11.5 Damages Cap
To the maximum extent permitted by law, our total liability to you for
all claims arising from or related to the App shall not exceed:

The amount you paid for Pinpin Premium (if you purchased it), OR
- β±1,000 PHP (whichever is greater)
11.6 Exclusion of Consequential Damages
In no event shall we be liable for:

Indirect, incidental, special, punitive, or consequential damages
- Loss of profits, revenue, data, or business opportunities
- Emotional distress or reputational harm
- Personal injury or property damage
This limitation applies even if we have been advised of the
possibility of such damages.
12. "AS IS" and "AS AVAILABLE" Disclaimer
The App is provided to you "AS IS" and
"AS AVAILABLE" with all faults and defects, without
warranty of any kind.
To the maximum extent permitted by Philippine law, we expressly disclaim
all warranties, whether express, implied, statutory, or otherwise,
including but not limited to:
- Implied warranties of merchantability
- Fitness for a particular purpose
- Non-infringement
- Title
- Accuracy or reliability of information
- Uninterrupted or error-free operation
- Freedom from viruses or harmful components
USE THE APP AT YOUR OWN RISK.
13. Indemnification
You agree to indemnify, defend, and hold harmless Pinpin, its developers,
employees, and affiliates from any claims, damages, losses, liabilities,
costs, or expenses (including reasonable attorneys' fees) arising from:
- Your use or misuse of the App
- Your violation of these Terms
- Your violation of any Philippine laws
- False or fraudulent information you provide
- Harassment complaints you file (whether true or false)
- Financial decisions you make based on the App
- Legal actions you take based on the App's guidance
14. Governing Law and Dispute Resolution
14.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws
of the Republic of the Philippines, including but not
limited to:

Republic Act No. 10173 (Data Privacy Act of 2012)

Republic Act No. 10175 (Cybercrime Prevention Act of
2012)

Republic Act No. 7394 (Consumer Act of the Philippines)
- Civil Code of the Philippines
14.2 Dispute Resolution
If you have any concern or dispute about the App, you agree to first try
to resolve the dispute informally by contacting us at
pinpinmanila@gmail.com.
If informal resolution fails, disputes shall be resolved through:

Mediation: Good-faith attempt at mediation before
litigation

Jurisdiction: Courts of competent jurisdiction in the
Philippines

15. Severability and Waiver
15.1 Severability
If any provision of these Terms is held to be unenforceable or invalid by
a court of law, such provision will be changed and interpreted to
accomplish the objectives of such provision to the greatest extent
possible under applicable law, and the remaining provisions will continue
in full force and effect.
15.2 Waiver
Our failure to enforce any right or provision of these Terms will not be
considered a waiver of those rights. Any waiver of any provision of these
Terms will be effective only if in writing and signed by us.
16. Changes to These Terms
We reserve the right to modify or replace these Terms at any time at our
sole discretion.
16.1 How We'll Notify You
- Email notification (if you've provided an email address)
- In-app notification when you open the App
- Updated "Last Updated" date at the top of this document
16.2 Material Changes
If a revision is material (e.g., changes to limitations of liability,
dispute resolution, or user rights), we will make reasonable efforts to
provide at least 30 days' notice prior to the new terms
taking effect.
16.3 Acceptance of Changes
By continuing to use the App after changes become effective, you agree to
be bound by the revised Terms. If you do not agree to the new Terms, you
must stop using the App.
17. Entire Agreement
These Terms, together with our
Privacy Policy, constitute the entire
agreement between you and Pinpin regarding your use of the App and
supersede all prior agreements and understandings, whether written or
oral.
